CODE ENFORCEMENT BOARD / PUBLIC NUISANCE ABATEMENT BOARD

The Code Enforcement Board / Public Nuisance Abatement Board are two separate boards comprised of the same members. Both Boards consist of seven (7) regular members with four (4) appointed by the mayor and approved by city council and three (3) embers appointed by city council.

The City of Tampa Code Enforcement Board (“CEB”) is authorized under Chapter 162, Part I, Florida Statutes, and Chapter 9, Tampa City Code. This administrative board has the authority to issue administrative fines and other noncriminal penalties to provide an equitable, expeditious, effective, and inexpensive method of enforcing codes and ordinances where a pending or repeated violation continues to exist. Presently this function is handled through local code enforcement magistrates.

The City of Tampa Public Nuisance Abatement Board (“PNAB”) is authorized under section 893.138, Florida Statutes, and section 14-291, Tampa City Code. The PNAB hears complaints investigated by the Tampa Police Department and filed by a prosecuting attorney alleging a place or premises has been the site of public nuisance conduct as defined under section 14-293, Tampa City code. Public nuisance conduct may include properties which have been used as a site of illegal felony drug violations, criminal street gang activity, dealing in stolen property, unlawful pain management clinic, unreasonably excessive noise, or crimes of violence. The law requires a site to be aware of the public nuisance activity and for due process of the law. The Tampa Police Department and the municipal prosecutor must follow the requirements to allow the property a chance to abate the nuisance before action is taken by the PNAB. Historically, properties advised of public nuisance conduct have abated the nuisance activity without action form the PNAB. Those properties that continue public nuisance conduct and are brought before the board may face the penalties as prescribed under section 14-296, Tampa City Code to include fines, costs, and procedures the PNAB deems appropriate to abate a nuisance in a particular case.

The Boards are scheduled to meet on the fourth Wednesday of the month at 9:00 a.m. at Old City Hall, City Council Chambers, 3rd Floor. These meetings are open to the public. These meeting are subject to change and the City Calendar should be consulted on future scheduled meetings. Applications can be found on the City of Tampa City Clerk webpage.
