Tampa Police Make Arrest in Fatal Crash On Dale Mabry Hwy

On June 3, 2024, at approximately 10:25 a.m. Tampa Police officers responded to the intersection of N Dale Mabry Hwy and W South Ave following reports of a two-vehicle crash.

Upon their arrival, officers located two victims in a 2015 Nissan Versa. The passenger, a white female in her early 60s, with life-threatening injuries, and the driver, a white male in his early to mid-70s, with non-life-threatening injuries.

Both subjects were transported to a local hospital, where the passenger was later pronounced deceased. The driver remains hospitalized and in stable condition.

The suspect, 22-year-old Andy Moya Robaina (W/M, 11/07/2001), was driving a 2011 BMW 335i at the time of the crash and did not report any injuries. He remained on scene following the incident.

Investigators were able to determine that Robaina was traveling southbound on N Dale Mabry Hwy at a high rate of speed, alongside another vehicle, that according to witnesses appeared to be racing. As the victim’s vehicle entered the roadway to cross N Dale Mabry Hwy near W South Ave, Robaina’s vehicle struck the victim’s vehicle from the inside lane. After re-directing, Robaina’s vehicle came to a stop on the northbound lanes of N Dale Mabry Hwy.

The other vehicle that was engaged with Robaina is believed to be a dark-colored vehicle. Moments before the crash, the dark-colored vehicle narrowly missed the Nissan and continued to travel southbound on N Dale Mabry Hwy. The vehicle did not stop or return to the scene.

There were no other occupants with Robaina at the time of the crash.

Robaina was taken into custody and transported to Orient Road Jail where he was charged with one felony count of Vehicular Homicide and one misdemeanor count of Unlawful Racing on a Highway.

Southbound and northbound lanes of N Dale Mabry Hwy were closed between W Hillsborough Ave and W MLK Blvd during the investigation, but have now reopened.

Investigators are diligently working to develop additional leads that will assist in identifying the driver of the dark-colored vehicle.
